This Risk Notice (the “Notice”), together with the Terms and Conditions, the Privacy Policy and any other terms referred to in those documents regarding the services and products provided and offered (hereinafter, the “Services”). and Products”) by Aquiles Inversiones S.A. de C.V (“Tokn1”), a company incorporated and registered in San Salvador, El Salvador, with address at Edificio Avante, level 7, Number 7-04, Santa Elena, Antiguo Cuscatlan, La Libertad, San Salvador, Republic of El Salvador , and establishes the risks to which the users of the Platform are subject (hereinafter, the “Users” or the “User”, interchangeably).

1. How to interpret a Risk Notice?

All terms used in this notice, which are defined in the Tokn1 Terms and Conditions (the «Terms»), have the same meaning and interpretation as in the Terms.

2. Servicios y Productos.

This notice provides you with information about the risks associated with Tokn1 Services and Products. Each Tokn1 Service and/or Products has its own associated risks. This Notice provides an overview of the risks when you use Tokn1 Services and Products.

This notice is not exhaustive, meaning it does not explain all risks or how those risks relate to your personal circumstances. It is important that you fully understand the risks involved before making the decision to use the Tokn1 Services and Products.

Tokn1 warns that the security tokens available on the Platform are highly risky and speculative. These are not suitable for most consumers, either as a means of investment or as a means of payment or exchange. Each person must operate them at their own risk and responsibility.

3. We do not provide personal advice.

Tokn1 does not provide any financial, legal or tax advice, nor does it propose any type of financial strategy. Tokn1 reminds its Users that it is important to do their own analysis before carrying out any operation with security tokens, based on their own personal circumstances.

4. Risks.

4.1 Risk of software weaknesses: the User understands and agrees that the underlying software is still in the development stage and has not been tested, that there is no guarantee that the process of receipt, use and ownership of Tokn1 tokens will be uninterrupted or error-free and that there is a risk inherent that the software and related technologies may contain weaknesses, vulnerabilities or errors that cause, among other things, the complete loss of your Tokens.

4.2 Regulatory risk: The User understands and accepts that blockchain technology allows new forms of interaction and that certain jurisdictions may apply existing regulations or introduce new regulations addressing applications based on blockchain technology, which may be contrary to the current configuration of Tokn1 and that may, among other things, lead to substantial modifications to the Tokn1 model, including its termination and the loss of User tokens.

4.3 Risk of abandonment: the User understands and agrees that the distribution and development of the Tokn1 platform may be abandoned for a number of reasons, including lack of public interest and lack of funding.

4.4 Risk of loss of private key: Tokn1 Wallet and tokens can only be accessed using your private credentials and/or private key that corresponds to the address it is stored at. User understands and agrees that if his/her private key is lost or stolen, the tokens stored in his/her wallet will be unrecoverable and will be permanently lost..

4.5 Risk of theft: the User understands and agrees that the underlying software of Tokn1 or the blockchain network on which Tokn1 is based may be exposed to hacker attacks that could result in the theft or loss of its tokens.

4.1 Availability. Software.

We do not guarantee that the Services and Products will be available at any given time or that the Services and Products will not be subject to unplanned service outages or network congestion. You may not be able to buy, sell, store, transfer, send or receive digital assets whenever you want.

4.2 Security.

Tokn1 cannot eliminate all security risks. You are responsible for keeping the password and email associated with your Tokn1 Account secure, and you will be responsible for all transactions on your Tokn1 Account, whether you authorize them or not. Transactions with Security Tokens are irreversible and losses due to fraudulent or unauthorized transactions may not be recoverable.

5. Responsibility:

We accept no liability for any loss of income or revenue, loss of business, loss of profits or contracts, loss of data, loss of administration or office time or for any indirect or consequential loss or damage arising out of, whether caused by in tort (including negligence), breach of contract or otherwise, even if foreseeable:

  • Errors made by the User of our website, Services or any Ethereum-related software or services, including forgotten passwords, accidental deletion of wallets, or payments sent to incorrect Ethereum addresses;
  • Software issues with our website, Services and/or any Ethereum-related software or services, including corrupted wallet files, improperly constructed transactions, insecure crypto libraries, malware affecting the website, Services and/or any software or services related to Ethereum;
  • Technical hardware failures or security issues experienced by the User of our Services or any (RED)-related software or services, including loss of data due to a faulty or damaged storage device, unauthorized access to wallets and/or or User accounts;
  • Actions or inactions of third parties and/or events experienced by third parties, including bankruptcy of service providers, information security attacks against service providers, and fraud carried out by third parties; or
  • Events, circumstances or causes beyond our reasonable control (force majeure).
